A. General Provisions

§ 1 Scope

These Terms and Conditions cover two things:

a) the contract between me, Jana Breitmar, and you as a consumer for the following paid offerings:

  1. the digital article „Wholesome Relationships" (digital content),
  2. the impulse cards „Perspective Shift" (physical product with digital online area, shipped by me; alternatively available as a purely digital online access),
  3. the „Statement Pieces" (hoodies with loving statements, made and shipped to order by my production and shipping partner Printful, Inc. or its EU subsidiary Printful Latvia AS).

b) the terms of use for my freely available content:

  1. my music at janabreitmar.de/en/music,
  2. my children's stories at janabreitmar.de/en/kidstales.

The provisions in section A apply to all paid offerings (items 1–3). The specific rules for each paid offering are set out in sections B to D. Section E sets out the terms of use for the freely available content (items 4–5).

§ 3 Conclusion of Contract

  1. The presentation of my offerings on the website is not a legally binding offer, but an invitation for you to place an order.
  2. By clicking the payment button in the checkout you submit a binding offer to purchase.
  3. The contract is concluded as soon as I accept your offer, by a confirmation email, by granting you access to the article, or by a shipping confirmation.
  4. Purchase of the article requires a user account and your agreement to these Terms. For the other offerings no account is required; agreement to these Terms is required.

§ 4 Prices and Payment

  1. The price shown on the website at the time of your purchase applies as the final price. I am a small business under § 19 of the German VAT Act (UStG) and therefore do not charge VAT. Shipping costs, where they apply, are shown additionally in the checkout.
  2. Payment is processed through the payment service provider Stripe (Stripe Payments Europe Ltd., Ireland); Stripe's terms apply in addition.
  3. The purchase price is due immediately upon conclusion of the contract.

§ 5 Data Protection

The processing of your personal data is carried out in accordance with the Privacy Policy.

§ 6 Liability

  1. I am liable for damages arising from the use of my offerings only in cases of intent or gross negligence. Liability for damages resulting from injury to life, body, or health and from the breach of essential contractual obligations remains unaffected.
  2. I am not liable for technical disruptions beyond my control (for example failure of third-party providers such as YouTube, Supabase, Stripe, or Printful).

§ 7 Changes to These Terms

  1. The version of the Terms published on the website at the time your contract was concluded applies to your purchase.
  2. Non-material changes (for example adjustments to contact details, clarifications, updates to the listed third-party providers) I also make with effect for existing contracts; I will notify you by email.
  3. Material changes that would noticeably affect your rights under the contract only apply to you if you actively consent to them.

§ 8 Final Provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. The contract language is German. This English version is provided for your information only; in the event of any inconsistency between the German and English versions, the German version shall prevail.
  3. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.

B. Digital Article „Wholesome Relationships"

§ 9 What you receive

With your purchase you receive permanent access to the digital article „Wholesome Relationships". You can read it after logging into your user account directly on janabreitmar.de and additionally download it as a PDF.

§ 10 Notes on Use

  1. This PDF article is based on my personal experiences and models and serves as an impulse for self-reflection. Feel free to critically examine my assumptions about the world for yourself.
  2. Engaging with your own relationship patterns and feelings can help you deal with them more constructively. However, it can potentially be triggering if unprocessed trauma lies behind your emotional challenge. If, while reading the article, you feel unwell in any way and experience distressing symptoms, it may be advisable to seek professional support from suitable medical and trauma-informed professionals. The PDF article is not intended to be a substitute for professional treatment or therapy.
  3. I point out that my offers do not guarantee any promises of healing or solutions to problems, and I accept no liability for particular desired effects failing to occur.

§ 11 Provision of Access

  1. After receipt of payment, access to the article is linked to your user account and unlocked immediately.
  2. Unfortunately I cannot guarantee continuous availability of the website. Short-term disruptions, maintenance, or outages do not constitute a defect of the digital content (§ 327i BGB). Since you can also save the article as a PDF, it remains available to you independently of this.
  3. The article is a living work: I revise, expand, or shorten it from time to time. With your purchase you also receive future updates at no additional cost. However, there is no entitlement to specific future content or a particular scope.

§ 12 Rights of Use

The article is intended exclusively for your personal use. You may pass the article on to people close to you within a normal, customary scope. Passing it on at scale, reproduction, publication, or commercial use are not permitted.

§ 13 Withdrawal

For digital content that is provided immediately, your right of withdrawal expires if, at the time of purchase, you expressly consent to provision beginning immediately and confirm that you thereby lose your right of withdrawal. You give this consent during the order process via a checkbox. With your purchase, access to the article is unlocked immediately and the right of withdrawal expires accordingly.

The statutory wording of the withdrawal instruction is set out in § 31.

§ 14 Warranty

For defects in the digital content, the statutory warranty rights apply (§§ 327 et seqq. BGB).

§ 15 Possible Shutdown of the Article

I reserve the right to take the article offline at a later date. In that case I will inform you in good time by email, at least three months before the planned shutdown, so that you have enough time to read it once more and save it as a PDF.

C. Impulse Cards „Perspective Shift"

§ 16 What you receive

You receive access to the „Perspective Shift" card set.

§ 16a Physical card set + box: You receive access to the physical card set with approx. 50 cards in a format of approx. 7 × 12 cm including a storage box. When you buy a physical card set, you additionally receive free access to the online area as a gift. The cards and the storage box are unlacquered and may show signs of wear with use; such signs of wear are consistent with the nature of the product and do not constitute a defect.

§ 16b Online area: You receive access to the digital online area in the login area of my website. Here you will find all approx. 50 cards in a digital version as well as a random draw function. This online area is accessible to you on janabreitmar.de immediately after purchase and logging in.

§ 17 Notes on Use

  1. This card set is based on my personal experiences and serves as an impulse for self-reflection. Feel free to critically examine my assumptions about the world for yourself.
  2. Engaging with your own feelings can help you deal with challenges more constructively. However, it can potentially be triggering if unprocessed trauma lies behind a challenge. If, while using the cards, you feel unwell in any way and experience distressing symptoms, it may be advisable to seek professional support from suitable medical and trauma-informed professionals. The card set is not intended to be a substitute for professional treatment or therapy.
  3. I point out that my offers do not guarantee any promises of healing or solutions to problems, and I accept no liability for particular desired effects failing to occur.

§ 18 Provision of Access

You receive your access to the card set in the following ways:

§ 18a Delivery of the physical card set + box: Shipping is handled by me, free of shipping costs and within Germany only. Delivery times are usually between 2 and 7 business days from receipt of payment.

§ 18b Unlocking of the online area:

  1. After receipt of payment, access to the online area is linked to your user account and unlocked immediately.
  2. Unfortunately I cannot guarantee continuous availability of the website. Short-term disruptions, maintenance, or outages do not constitute a defect of the digital content (§ 327i BGB).
  3. The online area is a living work: I revise or expand it from time to time. With your purchase you also receive future updates at no additional cost. However, there is no entitlement to specific future content or a particular scope.

§ 19 Rights of Use

  1. The card set is primarily intended for personal use. You may use the card set within a normal, customary scope for yourself and for people around you.
  2. If you are self-employed or run a small business with up to 10 people, you may also use my card set commercially without prior consultation, in order to draw one or more cards in a coaching session, a YouTube video, or a similar setting for other people. The condition for this is that it is a customary and fair use that names me in some form or links to the product's sales page.
  3. Businesses with 11 or more people, agencies, publishers, and corporations need my prior consent for commercial use. Please contact me by email at hallo@janabreitmar.de with a description of your plans and a concrete price proposal.
  4. In any case, the following are not permitted: reselling, publishing, or licensing my card set or individual cards as your own product, as well as any other abusive or unlawful use.
  5. If you are unsure, feel free to write to me beforehand.

§ 20 Withdrawal

You have the following right of withdrawal:

§ 20a Withdrawal of the physical card set + box: You have a 14-day right of withdrawal. The period starts when you receive the goods. You can declare the withdrawal in the order overview of your user account via the „Retoure/Reklamation" button (select „Retoure") or by sending me an informal email to hallo@janabreitmar.de; you do not need to give a reason (feedback is of course welcome). You return the goods at your own cost to the address that I will send you by email after your withdrawal (the address stated in the imprint does not accept parcels). I will refund the purchase amount once the goods have arrived with me. With the withdrawal of the physical variant, the free access to the digital online area included with it also ends. The statutory wording of the withdrawal instruction is set out in § 31.

§ 20b Withdrawal of the online area: For digital content provided immediately, the right of withdrawal expires once you expressly agree at purchase that provision should begin immediately and you confirm that you thereby lose your right of withdrawal. You give this consent during the order process via a checkbox. With the purchase, online access is unlocked immediately and the right of withdrawal expires accordingly. The statutory wording of the withdrawal instruction is set out in § 31.

§ 21 Warranty

The following warranty rights apply:

§ 21a Warranty for the physical card set + box: For defects in the cards delivered, the statutory warranty rights apply (§§ 434 et seqq. BGB), in particular the two-year limitation period under § 438(1) no. 3 BGB. Please report transport damage as soon as possible, this makes handling easier.

§ 21b Warranty for the online area: For defects in the digital content, the statutory warranty rights apply (§§ 327 et seqq. BGB).

§ 22 Possible Discontinuation of the Online Area

I reserve the right to possibly discontinue the digital online area at a later point in time. In that case I will inform you in good time by email, at least three months before the planned discontinuation, and will provide the cards to you as a download (e.g. as a PDF) in good time so that you can continue to use them.

D. Statement Pieces

§ 23 What you receive

  1. With your purchase you receive the product selected on the sales page (hoodie) with the respective statement in the variant you chose (for example size and colour, where available).
  2. Each hoodie is embroidered individually to order. Due to this individual production, minor variations in thread tension, position, size or colour of the embroidery may occur. Slight unevenness in the embroidery or slight puckering of the fabric around the embroidery are also possible. Such variations within the usual range are part of the nature of individually embroidered goods and do not constitute a defect. Your statutory rights in the case of genuine defects remain unaffected.

§ 24 Notes on Use

  1. To preserve the embroidery for a long time even after many washes, wash/dry the hoodie cold and inside out. Do not steam or iron.
  2. On the reverse of the embroidery there is a stabiliser (dark cardboard) stitched in; it is part of the embroidered goods and remains permanently in the product. Excess stabiliser at the edge or individual slightly longer secured threads can be carefully trimmed if desired and do not constitute a defect.

§ 25 Provision of Access

  1. Embroidery and shipping are handled to order by Printful, Inc. or its EU subsidiary Printful Latvia AS. For this purpose your order details (name, delivery address, order details) are transmitted to Printful; further information is available in the Privacy Policy.
  2. Shipping is currently within Germany only and is free of shipping costs for you.
  3. Delivery time consists of production (typically 2 to 7 business days) and shipping, and is usually 5 to 12 business days in total.

§ 26 Withdrawal

As a consumer you have a 14-day right of withdrawal. The period starts when you receive the goods. You can declare the withdrawal in the order overview of your user account via the „Retoure/Reklamation" button (select „Retoure") or by sending me an informal email to hallo@janabreitmar.de; you do not need to give a reason (feedback is of course welcome). You return the goods at your own cost to the address that I will send you by email after your withdrawal (the address stated in the imprint does not accept parcels). I will refund the purchase amount once the goods have arrived with me. The statutory wording of the withdrawal instruction is set out in § 31.

§ 27 Warranty

For defects in the goods delivered, the statutory warranty rights apply (§§ 434 et seqq. BGB), in particular the two-year limitation period under § 438(1) no. 3 BGB. Please report transport damage as soon as possible, this makes handling easier.

E. Freely available content: Music & Children's stories

I provide my music and my children's stories on janabreitmar.de free of charge for streaming and partly for download. No purchase contract is concluded between us in this respect. If you download or further use this content, the following terms of use apply.

§ 28 Use of my music

  1. You may freely listen to my music, download it, and save it on your own devices for private purposes.
  2. If you are self-employed or run a small business with up to 10 people, you may also use my music commercially without prior consultation, for example as background music in social media posts, reels, videos, or podcasts. I appreciate a tag or mention, but it is not required. Parts of the music are additionally available via the Instagram music library.
  3. Companies with 11 or more people, agencies, publishers, and corporations require my prior consent for commercial use. Please contact me by email at hallo@janabreitmar.de with a description of your project and a specific price proposal.
  4. In any case, the following are not permitted: reselling, selling, or licensing my music as your own product; uploading to commercial streaming platforms under your own or a third party's name; edits, remixes, or sampling for the purpose of commercial reuse without my consent; any abusive or unlawful use.
  5. If you are unsure, feel free to drop me a quick message beforehand.

§ 29 Use of my children's stories

  1. You may freely listen to and download the children's stories (audio) and share them within your family for private purposes.
  2. Individual educators (for example teachers, kindergarten staff, therapists) as well as smaller institutions (kindergartens, daycare, learning groups) may use my stories in educational and supportive contexts without prior consultation, including reading aloud and audio playback for the children in their care.
  3. Companies, publishers, platforms, agencies, and similar institutions require my prior consent for use going beyond paragraph 2. Please contact me by email at hallo@janabreitmar.de with a description of your project and a price proposal.
  4. In any case, the following are not permitted: reselling, selling, or licensing my stories as your own product; publication on commercial platforms under your own or a third party's name; edits or translations for the purpose of commercial reuse without my consent; any abusive or unlawful use.
  5. If you are unsure, feel free to drop me a quick message beforehand.

§ 30 Note on AI-assisted content and liability

  1. For part of my music I have used AI-assisted tools in production. The lyrics of my songs are written by me. Before publishing, I check the results to the best of my knowledge, but I cannot rule out that AI models may, in rare cases, produce sounds that unintentionally resemble existing works.
  2. At the time of publication, I am not aware of any infringements of copyright or related rights of third parties. If you have any indications of a possible infringement, please contact me at hallo@janabreitmar.de; I will follow up on any notice immediately.
  3. If you use my music commercially, I recommend that you carry out your own assessment of possible legal risks. When used commercially by businesses, you act on your own responsibility; my liability for damages arising from such uses is governed by § 6 of these Terms.
  4. Because I provide my music and children's stories free of charge, I am only liable for damages arising from their use in cases of intent and gross negligence (analogous to the donor liability under § 521 German Civil Code). For slight negligence my liability is excluded. This does not affect my liability for damages arising from injury to life, body, or health, or from the breach of material obligations — for those I remain liable under the statutory provisions.

F. Appendix

§ 31 Withdrawal Instruction (statutory wording)

For completeness, here is the formal withdrawal instruction in the wording prescribed by law:

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days

  1. in the case of a contract for the supply of digital content, from the day of conclusion of the contract;
  2. in the case of a contract for the supply of goods, from the day on which you, or a third party other than the carrier and indicated by you, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Jana Breitmar, c/o Impressumservice Dein-Impressum, Stettiner Str. 41, 35410 Hungen, Germany, email: hallo@janabreitmar.de) by means of a clear statement (for example, by email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send the notification regarding the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this repayment.

In the case of a purchase of goods we may withhold the reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You will only have to pay for any diminished value of the goods if such diminished value results from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Premature Expiry of the Right of Withdrawal
For a contract for the supply of digital content not supplied on a tangible medium, the right of withdrawal expires if you have expressly agreed that we begin performance of the contract before the expiry of the withdrawal period, and you have confirmed your knowledge that you lose your right of withdrawal by your consent upon commencement of performance.

A model withdrawal form is set out in § 32.
